Without prejudice to the other provisions of this Agreement, Brilliant Resumes shall not be liable for any loss and damage, costs and expense that the Client/Member may suffer or incur, and no fees or charges payable by the Client/Member to Brilliant Resumes shall be deducted, refunded or rebated, as a result of such deactivation or suspension.
Without prejudice to any other rights or remedies of Brilliant Resumes, Brilliant Resumes may suspend the service agreed or being provided in the event that any dues payable by the Client is not paid completely or is paid partially. Upon suspension, the service shall be deemed to be terminated from the date stipulated by Brilliant Resumes and the Client shall be liable for all charges and fees incurred until that date. Upon subsequent payment by the Client of the requisite payment on demands, Brilliant Resumes may at its sole discretion and subject to such terms as it deems proper, reconnect the Service.
a) The Client will not allow any person other than the authorized person(s) named in the application/agreement/consent form to use the Service. Brilliant Resumes reserves its right to disclose any information regarding any order only to the person named in the document being processed i.e. to the person to whom the order belongs to.
b) The Client/Member shall use the Service only for the purpose for which it is subscribed.
c) The Client/Member will comply with all applicable laws and shall not contravene any applicable law of India relating to the Services, including any regulation made pursuant thereto.
d) The Client/Member shall not use the Service(s) for any unlawful purpose including without limitation criminal purposes.
e) The Client/Member shall not to use the Service to send or receive any message, which is offensive on moral, religious, racial or political grounds or of an offensive, vulgar, obscene, malicious or menacing nature.
f) The Client/Member is prohibited to introduce post or transmit any information or software, which contains a virus, worm or other harmful component into the Internet or www.brilliantresumes.net network system.
g) The Client/Member will not breach on any intellectual property rights of any person or retain information in any computer system or otherwise with such intention.
The Client/Member hereby agrees and irrevocably authorizes the Company to:
a) Use any data and information supplied by the Client/Member in connection with this Agreement for the Company’s own purpose, to the company supplying such data and information to any other associated companies or selected third parties including search engines.
b) Use any data furnished by the Client/Member in order to float offers or send mails regarding specific services and such mails or messages may not been proclaimed or deemed to be unsolicited communiqué.
c) Allow all data and information supplied by the Client/Member in using the Service to remain at Brilliant Resumes for the use of the Company in accordance with service agreement with the Client/Member, notwithstanding the termination or suspension of the Service to the Client/Member herein.
Brilliant Resumes reserves the right to block / suspend / hold / de-activate the services of the Client/Member in case, any of the following is found:
a) harasses or advocates harassment of another person;
b) is offensive to the online community, any such content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
c) involves unsolicited mass mailing or “spamming”, the transmission of “junk mail”, “chain letters”;
d) promotes any information that is misleading, is false or that promotes illegal activities;
e) or where the conduct of the Client is abusive, threatening, obscene, or defamatory towards the firm Brilliant Resumes, and/or towards its employees;
f) promotes unauthorized or an illegal copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices;
g) contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
h) displays pornographic or obscene or sexually explicit material of any kind;
i) provides any kind of instructional information about illegal activities such as violating someone’s privacy, making or buying illegal weapons, or providing or creating computer viruses, or hacking;
j) solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
k) Brilliant Resumes also reserves all rights to suspend or terminate the services if found the services is not being used as per the mentioned instructions or the case may be.

b) Brilliantresumes.net does not promise any jobs or interview calls to the end user after taking its services. The services provided by Brilliantresumes.net are best effort and best in class but the end user needs to understand that there is a large skilled population out there and a comparatively lesser number of qualified jobs open in the market and hence guaranteeing a job is not possible.

In addition to but separate from the above specific exclusion and to the full extent allowed by applicable law, you also agree that Brilliant Resumes will not be liable to you for any other indirect, special, consequential incidental, punitive or exemplary damages whatsoever that arise out of or are related to your use of the Brilliant Resumes sites.

You agree that your only other remedy (including for negligence) for any damages that you incur arising out of your use of the Brilliant Resumes sites to the extent that Brilliant Resumes liability is not excluded is as follows: if you have subscribed to receive any paid services, your remedy is limited to the direct damages you actually incur arising out of your use of the Brilliant Resumes sites. You may at your option receive paid services to the equivalent value of this limit in place of monetary damages.
Without limiting the above, Brilliant Resumes is not liable for matters beyond its reasonable control. Brilliant Resumes does not control telephones, third party communications networks (including your Internet Service Provider) or the Internet or the acts of third parties.
You agree to indemnify and hold Brilliant Resumes, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.

Third party sites may be co-branded with Brilliant Resumes and so include Brilliant Resumes trade mark. If you purchase products or services from a Third party site your contract for such products or services will be with the third party and not with Brilliant Resumes. You are informed that under no circumstances will Brilliant Resumes be liable for any damage caused of whatever nature because of such fraudulent individuals or organizations. The Client/Member shall be solely responsible, and Brilliant Resumes shall not be liable in any manner whatsoever, for ensuring that in using the Service, all applicable laws, rules and regulations for the use of systems, service or equipment shall be at all times complied with.
Brilliant Resumes makes no representations and warranties of any kind, whether expressed or implied, for the Services and in relation to the accuracy or quality of any information transmitted or obtained through the Services of www.brilliantresumes.net.
Brilliant Resumes shall not be liable for any loss or damages sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the Client’s/Member’s account and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed.
The Client/Member acknowledges that it is not the organization’s policy to exercise editorial control over and to edit or amend any data or contents of any emails or posting or any information that may be inserted or made available or transmitted to a third party in or through brilliantresumes.net. Brilliant Resumes may refuse, suspend, terminate, delete or amend any artwork, materials, information or content of any data or information or posting so as, in the sole opinion of Brilliant Resumes, to comply with the legal or moral obligations and to avoid infringing a third party’s rights or any other rules, standards or codes of practices that may be applicable to the posting or www.brilliantresumes.net or the internet.
All information(s) received from you for your use of the Brilliant Resumes sites will be used by Brilliant Resumes in accordance with our Privacy Policy. Each registered Client/Member is individually responsible for usage of any type of Brilliant Resumes information or anyone else using your ID and for preventing unauthorized use of your ID or registration info. If you believe there has been any breach of security such as the disclosure, theft or unauthorized use of your ID or any payment information, you must notify Brilliant Resumes immediately by e-mailing contact@brilliantresumes.net. We recommend you to change password of your User Name on regular basis to avoid any misuse.
If you provide Brilliant Resumes with an email address or phone number that results in any emails or SMS messages from Brilliant Resumes being sent to you via a computer network or telephone operated or owned by a third party (e.g. your employer or your institution) then you warrant that you are entitled to receive those messages. You also agree that Brilliant Resumes may refrain from sending messages to you without notifying you, even if you have subscribed to receive them, if we receive a request from a third party to stop sending emails or SMS messages to you.
Brilliant Resumes maintains a policy of strict confidentiality of all data and information submitted by the Member. Members need to be aware that when they voluntarily reveal identification oriented information (name, e-mail address) in chat and bulletin board areas, such information may be collected by a third party resulting in unsolicited messages from third parties. Such interaction is beyond the control and liability of Brilliant Resumes.
The copyright, know how or any other related intellectual property to the Service or Brilliant Resumes shall be the sole and exclusive property of Brilliant Resumes. In the event the Client/Member has contributed any content to Brilliant Resumes in any manner whatsoever, the intellectual property of the same shall stand automatically assigned to Brilliant Resumes and the Client/Member shall have no right or claim over the same. In the event the Client/Member during the term of his agreement or any time thereafter, uses such intellectual property in any other website or related activity, the same can be construed to be an infringement of the intellectual property belonging to Brilliant Resumes and Brilliant Resumes shall have the right to legal recourse in this regard.
Resume Development Service: Brilliant Resumes operates several paid services. By subscribing to receive any of these services, as well as the above terms and conditions, you are also agreeing to the following terms:
a) The Client/Member will comply with all notices or instructions given by Brilliant Resumes from time to time in respect of the use of the Service.
b) Certain areas of services of Brilliant Resumes sites are only accessible to users who pay to subscribe.
c) You agree to pay any subscription fees at the rates in effect when the charges are incurred.
d) Brilliant Resumes will start its paid services only upon realization of the complete amount/fee/charges upfront, full in advance. Brilliant Resumes reserves its right to hold/suspend any order if full payment is not received or partial payment is made.
e) If we do not receive payment authorization or any authorization is subsequently cancelled, (either by the bank or payment gateway or banking partner or the Client) we may immediately terminate or suspend your access to any paid-for services.
f) You must provide us with complete and accurate payment information.
g) In the case of unauthorized payments Brilliant Resumes reserves the right to suspend or terminate your access to the online services.
h) You can pay by either credit or debit card through your bank’s internet payment gateway. By submitting credit or debit card payment details to Brilliant Resumes you warrant that you are entitled to purchase the subscription services using those payment details.
i) Brilliant Resumes will charge you in Indian rupees (INR), and any payment in other any other currency will be calculated at the relevant rates of exchange. You may also have to pay any applicable local taxes. Brilliant Resumes will not entertain any dispute about the rate at which your currency is converted into Indian Rupees since these transactions are determined as per the agreement of Brilliant Resumes with CCAvenue/Paypal/Instamojo/Razorpay or any banking partner or our payment gateway partners, and their agreement with banks and credit card companies.
j) The service would entail you to receive a soft copy of resume from Brilliant Resumes. Not more than one resume (or as per order placed) is provided per service request and this does not compulsorily include a covering letter.
k) Brilliant Resumes will try to process your order/subscription promptly but does not guarantee that the paid services will be available to you within your specified time. We work according to our organization timelines. Whenever any change / modification is requested in the resume after the delivery of first version/draft, it takes approximately 3-7 working days to revert back with the modified resume whenever requested for. Also as it is practically not possible to keep making changes on every single request, hence, it is recommended to our Clients that they provide us all the desired modifications in one single mail, to complete them at the earliest.
l) Our delivery period starts from the same time of next working day, after the date on which payment hits the account of Brilliant Resumes.
m) Brilliant Resumes reserves the rights to reject working on any resume at any stage of the process, if it is noticed that the terms and conditions have not been complied with.
n) Brilliant Resumes would provide the subscribed services only within the time period mentioned in our email communications to you or as mentioned on our website for said service and provided that all required information’s are received on time and are complete as per expectations of Brilliant Resumes.
o) Please note that as a process we cannot keep our old orders in ‘open’ status for longer duration especially in cases where the Client(s) do not respond back or provide any communication for 30 days (non-communication period). Hence in such conditions where there is no communication received from the Client on his/her order for 30 days from the date of last communication / date of last delivery made to the client, the order will be automatically marked as Closed and no further support will be provided on this Order after that.
p) To re-activate Closed order again for any modifications/changes/re-print/re-delivery or for any other purposes i.e. after 30 days of the non-communication period mentioned in above clause, the client will have to make the payment of not less than 50% of the original order amount again.
q) There will be separate charges for re-writing the resume again, if required to suit a different job profile other than the one availed for and once the non-communication period of 30 days is expired.
r) Brilliant Resumes offers no job guarantee or assurance for the resume developed. The service would only help you get your resume crafted in a powerful way and as per the market trends.
s) The liability, if any, of Brilliant Resumes is limited to the extent of the amount paid by the Client/Member.
t) All outstanding balances must be cleared and must be paid in full in order to avail the complete services of the services subscribed/registered for.
a) If you are, for any reason, not happy with your purchase, we will cheerfully raise your refund request received within 24 hours of your purchase, if any. This condition excludes the Orders placed under Express Delivery where the First Draft of Resume / Service is delivered within 24 hours. There is Zero Refund policy for Express Delivery Orders.
b) We develop and cater our services every day to lots of satisfied customers, and our support is second to none. To request a refund, simply mail us your request on contact@brilliantresumes.net with your order details within Twenty Four Hours (24 Hrs) of your purchase. Please include your Order Number (informed to you while placing order) and optionally tell us the reason why you’re requesting a refund – we take customer feedback very seriously and use it to constantly improve our products and quality of service.
c) No requests for refunds will be entertained made after 24 hours of your purchase.
d) Taxes deducted once will not be refunded back in any case.
e) Refund requests will be processed and managed on case to case basis and the decision to refund will be made in the absolute discretion of Brilliant Resumes.
f) If agreed by Brilliant Resumes, refund will be processed and will be credited back to the original credit/debit card or bank account as per the timeframe of respective Bank which is usually between 75 days (for VISA/MASTER) and 120 days (for AMEX) as per their rules. Brilliant Resumes does not have any control on the processing or timelines prescribed by the bank and is not responsible for any such issues.
g) Brilliant Resumes will not refund the payment/charges for Resume Development Service once the payment has been made to Brilliant Resumes and the process has been initiated which includes the first level discussion with the assigned Resume Writer. Refunds are not being provided for any service which is delivered in partial or full, such as after delivery of first draft, or after having carried any modifications/iterations/rectifications as per client feedback.
h) In the case of unauthorized payments / payment rejected / transaction marked as high-risk / stolen or fraud cards / chargeback or refund, either written or verbal to the bank / credit card company / payment gateway, Brilliant Resumes reserves the right to suspend or terminate your services with immediate effect, either temporarily or permanently, partial or completely and no further services or support or responses will be provided to the client until the disputed subject matter is resolved.
i) Incase any member defames Brilliant Resumes on public forum / blogs / public domains & websites / Social Media sites, same will be considered as acting against Brilliant Resumes and hence the member / client order ID will be blocked in the system with immediate effect and no further request of any sort/value will further ever be entertained by Brilliant Resumes till he / she removes the post. Brilliant Resumes will also have the right to take a legal action / file a case against such people / clients participating in such activities.
This Agreement, accepted upon use of the Site and further affirmed by becoming a Client/Member of the Brilliant Resumes service, contains the entire agreement between You/Member and Brilliant Resumes regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. These terms and conditions shall be governed by, and construed in accordance with laws of the Government of India. Users of Brilliant Resumes websites also explicitly agree that only courts in India shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of Indian courts.
You are solely responsible for your interactions with Brilliant Resumes and Brilliant Resumes reserves the right, but has no obligation, to monitor disputes between you and other Members or any third-party.
Any dispute arising out of this agreement will be subject to the jurisdiction of Kolkata and no courts other than courts of Kolkata shall have jurisdiction to try the same. Any dispute between the parties shall be referred to a named arbitrator appointed by Brilliant Resumes under the Arbitration and Conciliation Act of 1996. The decision of the Arbitrator shall be final and binding on both the parties. The Arbitration proceeding will be conducted at Kolkata in English language only.
All communication, including notices and legal communications, should be addressed to Brilliant Resumes, at the mentioned address.
These terms and conditions are effective from Sept 24, 2021.
